Terms of use agreement

„Seller” is an e-shop „FavoritePostcard.com“; 
„Buyer” is a person, who buys Items from the Seller an pays a Price set;
„Items” are postcards and other products, which Buyer agrees to buy from Seller;
„Price” is a price for Items including all taxes and delivery costs. 
„Terms and Conditions” are selling terms and conditions presented in this document. The agreement enters in to force when a Buyer checks the mark that he agrees to the terms and conditions and clicks on “buy”.

1 Conditions

1.1 These conditions set the mutual rights and responsibilities of Buyer and Seller when the Buyer purchases the Items.
1.2 In accordance with the terms and conditions Seller agrees to transfer Items to the Buyer and the Buyer undertakes to accept the Items and pay for them in accordance with the rules ant terms set.

2 Price and Payment

2.1 The range of items and prices are indicated in an online shop at the time of agreement. 
2.2 If Buyer does not pay for Items on time (3 hours), Seller can suspend the purchase and the agreement. 

3 Items

3.1 Seller is obliged to provide a picture and description of the Item in the e-shop.
3.2 Seller is allowed to change the assortment of the Items in the shop and upgrade their quality at his own will.
3.3 The products purchased on this site are for private and domestic use only and are not for resale. Buyer is obliged to use the Items for his personal use only, not to use the images of the postcards and other products for commercial or other uses without the written agreement from the Seller.

4 Warranties and Responsibilities

4.1 Faulty Items, when Seller is responsible, can be exchanged, after Buyer provides order number, delivery date and reasons for the exchange in written form and returns the Items to Seller at his own expense. The Seller is obliged to exchange the Item within 30 days after he has received the Item.
4.2 Buyer has a right to return the Items within 14 days of delivery, paying Items delivery costs himself. The cost of Item delivery is non-refundable. The Seller is obliged to transfer the money to Buyer within 15 days after receiving the Items.

5 Delivery

5.1 Seller is obliged to send Items on time, which is stated at the time of purchase. It is our policy to try to despatch all orders within 3 working days.
5.2 Seller is obliged to send Items by post to the address provided by Buyer.
5.3 Buyer is obliged to provide his relevant and accurate data.

5.4 For not European Union countries parcels can be subject to import taxes, customs duties, and/or fees imposed by the destination country. These charges are typically due once the package arrives in the destination country. Depending on the country, the buyer may be required to pay these charges at the time of delivery.
5.5 If customer have chosen shipping method with out tracking nubeer it will not cover your order in cases of loss of package as there is no way to track your order once it’s shipped from our end. We always recommend choosing shipping with tracking. 

6 Privacy

When you shop on favoritepostcard.com, we will ask you to input personal details in order for us to identify you, such as your name, e-mail address, delivery address, phone number. By submitting your email address in connection with the order/purchase process, you agree that we may use your email address to contact you for matters regarding your order.

Seller undertakes not to disclose Buyers data to third parties.

7 Final Provisions

7.1 All notifications and questions should be e-mailed to addresses provided in Sellers e-shop. All Information from Seller to Buyer is sent to e-mail provided by Buyer.
7.2 All disputes, disagreements and claims between Buyer and Seller arising from this Agreement or related thereto shall be investigated and resolved through negotiations. The opening of negotiations is considered a Party written appeal to the next, with the object of the dispute, damage removal method and terms.
7.4 All disputes arising from the implementation of this Agreement shall be dealt with by negotiation. Failing to solve the dispute through negotiations, it is dealt in accordance to the laws of the Republic of Lithuania. 

TERMINAI IR SĄLYGOS [Lithuanian translation]

NAUDOJAMI TERMINAI:

„Pardavėjas” yra el. parduotuvė „FavoritePostcard.com“; 
„Pirkėjas” yra asmuo, kuris perka iš Pardavėjo Prekes ir už jas sumoka nustatytą Kainą;
„Prekės“ yra atvirlaiškiai ir kiti produktai, kuriuos Pirkėjas sutinka pirkti iš Pardavėjo;
„Kaina“ yra kaina už prekes įskaitant visus mokesčius ir siuntimo išlaidas.
„Sąlygos“ yra pardavimo sąlygos ir terminai išdėstyti šiame dokumente. Sutartis įsigalioja Pirkėjui pažymėjus varnelę, kad sutinka su “Terminais ir Sąlygomis” ir paspaudus mygtuką „pirkti“ ar jo alternatyvą.

1 SĄLYGOS

1.1 Šios sąlygos nustato Pirkėjo ir Pardavėjo tarpusavio teises, pareigas ir atsakomybę, Pirkėjui įsigyjant Prekes.
1.2 Sąlygose nustatyta tvarka Pardavėjas įsipareigoja perduoti Prekes Pirkėjui, o Pirkėjas įsipareigoja priimti užsakytas Prekes ir atsiskaityti už jas taisyklėse nustatyta tvarka ir terminais.

2 KAINA IR APMOKĖJIMAS

2.1 Prekių asortimentas ir kaina yra nurodomi sutarties sudarymo momentu elektroninėje parduotuvėje. 
2.2 Jei Pirkėjas per per 3 valandas nesumoka už prekes, Pardavėjas sustabdo pirkimą, anuliuoja užsakymą ir sutarties galiojimą.

3 PREKĖS

3.1 Pardavėjas įsipareigoja savo parduotuvėje pateikti prekės nuotrauką ir aprašymą.
3.2 Pardavėjas savo nuožiūra gali keisti prekių asortimentą, taip pat gerinti jų kokybę.
3.3 Pirkėjas įsipareigoja prekes naudoti tik savo asmeniniams tikslams, nenaudoti produktuose vaizduojamų autorinių paveikslėlių komerciniams ir kitiems tikslams be išankstinio raštiško pardavėjo sutikimo.

4 GARANTIJOS IR ATSAKOMYBĖ

4.1 Nekokybiškos prekės, kai dėl to kaltas Pardavėjas gali būti pakeistos į kitas, prieš tai Pirkėjui raštu nurodžius užsakymo numerį, gavimo datą, bei keitimo priežastis ir sugrąžinus Pardavėjui prekes. Pardavėjas įsipareigoja per 30 dienų pakeisti nekokybišką prekę nuo Prekės gavimo atgal. 

4.2 Pirkėjas turite teisę per 14 dienų nuo atvirukų gavimo savo lėšomis grąžinti prekes. Prekių siuntimo mokestis negrąžinamas jei prekės grąžinamos ne dėl Pardavėjo kaltės. Pardavėjas įsipareigoja pervesti pinigus per 15 darbo dienų nuo Prekės gavimo atgal.

5 PRISTATYMAS

5.1 Pardavėjas įsipareigoja išsiųsti Prekes per 3 darbo dienas gavus apmokėjimą.
5.2 Pardavėjas įsipareigoja išsiųsti prekes paštu Pirkėjo nurodytu adresu.
5.3 Pirkėjas įsipareigoja nurodyti teisingus savo duomenis.

5.4 Ne Europos Sąjungos šalyse gavėjui gali tekti sumokėti importo mokesčius. Jie priklauso nuo gavėjo šalies.

5.5 Jei klientas pasirinko siuntimo būdą be sekimo numerio, mes neatsakome už jo praradimą siuntimo metu. Visais atvejais rekomenduojame rinktis siuntimą su sekimu.

6 PRIVATUMO POLITIKA

Visų favoritepostcard.com Pirkėjų, prašome nurodyti tokius asmeninius duomenis, kaip vardas ir pavardė, el. pašto adresas, telefono numeris, prekės pristatymo adresas. Įrašydamas savo el. pašto adresą bei telefoną Pirkėjas sutinka, kad šie duomenys gali būti naudojami susisiekti dėl užsakymo iškilusiais klausimais, pvz., jei reikia patikslinti adresą ir pan. atvejais. 

Pardavėjas neskelbia Pirkėjo duomenų trečiosioms šalims išskyrus tuos, kurie reikalingi sklandžiam užsakymo pristatymui, pvz., adresas perduodamas pašto kurjeriams.

7 BAIGIAMOSIOS NUOSTATOS

7.1 Pirkėjas visus pranešimus ir klausimus siunčia Pardavėjo elektronines parduotuvės kontaktais ar elektroniniu paštu info@favoritepostcard.com. Pardavėjas informaciją siunčia Pirkėjo nurodytu elektroniniu pašto adresu.
7.2 Visi ginčai, nesutarimai ir reikalavimai tarp Pirkėjo ir Pardavėjo, kylantys iš šios Sutarties ar su ja susiję, nagrinėjami ir sprendžiami derybų keliu. Derybų pradžia laikytinas vienos Šalies raštiškas kreipimasis į kitą, nurodant ginčo objektą, pažeidimų pašalinimo būdą ir terminus.
7.4 Visi ginčai, kilę dėl šios Sutarties įgyvendinimo, sprendžiami derybų keliu. Neišsprendus ginčo derybų keliu, jis sprendžiamas Lietuvos Respublikos įstatymų numatyta tvarka.
